Chavez" to this Short Title in bill S.2703. While this bill was reported to the Senate, it was never voted on; rather, the bill was replaced by the amended H.R. 9, which had already passed the House and was later approved by the Senate. The name "Cesar E. Language-minority groups are “persons who are American Indian, Asian American, Alaskan Natives or of Spanish heritage." At the time of the 2006 renewal, this section applied to 466 jurisdictions in 31 states.

Congressman Steve King of Iowa presented an amendment to the bill that would delete this section and take away the requirement that translators and miltilinguals ballots be provided for language-minority voters. It failed. However, it continued to be a point of contention and opposal for many conservatives, tied up in the then-current heated debates on immigration. Conservatives affirmed America as an English speaking country, believing preservation of minority languages would lead to a divided America.

Passage of the Law

 http://www.msnbc.msn.com/id/14059113/

 Pool/Getty Images

President George W. The event celebrated the popularity of the law, as it had passed the Senate 98-0 and the House 390-33. The bill was signed on the same day as President Bush's historic visit to the NAACP convention, and public discourse cited the Republican party's attempt to garner minority support as one of the reasons the renewal enjoyed bipartisan backing.

Enactment of the Law

Although the Voting Rights Act Renewal was signed into law July 27, 2006, the provisions of the 1982 renewal did not expire until July 1, 2007. This was a point brought up by House Representative Rep. Lynn Westmoreland and others opposed to the passage of the bill, with a claim that the timing was rushed and more time was needed to debate the bill. Those supporting the bill countered that the act had been under committee consideration since the fall of 2005, regardless of when it was introduced on the floor, and that that was plenty of time for consideration.

Voting Rights Act of 1965

The Voting Rights Act of 1965 was a groundbreaking law designed to halt racially discriminatory voting practices, especially in the South, signed into law by President Lyndon B. Johnson on August 6, 1965. The act outlawed literacy tests and poll taxes, administered primarily to weed out Black citizens, and other procedures of a discriminatory nature. It provided for federal registration and Department of Justice over-site to registration practices in areas in which less than 50% of minority voters were registered to vote. The law also required areas in which less than 50% of the population was registered (in 1964) to receive federal preclearance from the Department of Justice before they could change voting laws.

Many consider the act to be highly successful and directly responsible for a more representative America, both at the polls and in elected officials. Appeals to its success were touted often in the congressional and popular debates.

Section 9

This section of the bill was not originally included when it was first introduced in the House by Rep. Sensenbrenner, but was added by the House Committee on the Judiciary. This originally included states in which less than 50% of the voting population was registered to vote in in 1960 and/or 1964, although some counties and towns have since been added. Since the provision was extended in 1982, the federal government has objected to and stopped hundreds of proposed changes on the premise of a discriminatory impact or intent. If a region shows nondiscriminatory behavior for 10 years and has taken affirmative action measures, they are then exempt from the preclearance procedures; some counties and towns in Virginia have met this requirement.

Nine Southern states still fall under this law: Alabama, Alaska, Arizona, Georgia, Louisiana, Mississippi, South Carolina, Texas, and Virginia (minus some counties and cities). Various cities and counties in California, Florida, New York, North Carolina, South Dakota, Michigan, and New Hampshire also fall into this category.

This section became a point of contention for a group of Southern Republicans, led by Georgia congressmen Lynn Westmoreland and Charlie Norwood, who said this provision unfairly discriminated against certain regions that ceased to be racist decades ago. Westorland presented an amendment to speed up the "bail out" process, which Norwood sought to change the ways in which regions were chosen to fall under this provision. Both amendments failed, but their opposition was well discussed in the public arena.

Periodic Renewal

The temporary revisions of the original Voting Rights Act of 1965 have been renewed four times: in 1970, 1975, 1982, and 2006. In 1982, congress voted to make some of the temporary provisions permanent, including section 2, a blanket statement prohibiting any sort of practice that results in voter discrimination regardless of intention. All other temporary provisions were extended for 25 years, to be expired on July 1, 2007. Congress therefore acted to renew this law a year in advance of its technical expiration. One House amendment attempted to limit this extension to 10 years, but failed on the floor.

Home

The Voting Rights Act Renewal of 2006

"Fannie Lou Hamer, Rosa Parks, and Coretta Scott King Voting Rights Acts Reauthorization and Amendment Act of 2006"

[DOCID: f:publ246.109]
[[Page 120 STAT. 577]]
Public Law 109-246
109th Congress

 An Act .

To amend the Voting Rights Act of 1965. <<NOTE: July 27, 2006 - [H.R. 9]>>
Be it enacted by the Senate and House of Representatives of the United States of America in Congress <<NOTE: Fannie Lou Hamer, Rosa Parks, and Coretta Scott King Voting Rights Act Reauthorization and Amendments Act of 2006. 42 USC 1971 note. 42 USC 1973 note.>> assembled,

SECTION 1. SHORT TITLE. This Act may be cited as the ``Fannie Lou Hamer, Rosa Parks, and Coretta Scott King Voting Rights Act Reauthorization and Amendments Act of 2006''.

SEC. 2. This progress is the direct result of the Voting Rights Act of 1965.
(2) However, vestiges of discrimination in voting continue to exist as demonstrated by second generation barriers constructed to prevent minority voters from fully participating in the electoral process.
(3) The continued evidence of racially polarized voting in each of the jurisdictions covered by the expiring provisions of the Voting Rights Act of 1965 demonstrates that racial and language minorities remain politically vulnerable, warranting the continued protection of the Voting Rights Act of 1965.
(4) Evidence of continued discrimination includes--

 (A) the hundreds of objections interposed, requests for more information submitted followed by voting changes withdrawn from consideration by jurisdictions covered by the Voting Rights Act of 1965, and section 5 enforcement actions undertaken by the Department of Justice in covered jurisdictions since 1982 that prevented election practices, such as annexation, at- large voting, and the use of multi-member districts, from being enacted to dilute minority voting strength;
(B) the number of requests for declaratory judgments denied by the United States District Court for the District of Columbia; and
(D) the litigation pursued by the Department of Justice since 1982 to enforce sections 4(e), 4(f)(4), and 203 of such Act to ensure that all language minority citizens have full access to the political process.
(5) The evidence clearly shows the continued need for Federal oversight in jurisdictions covered by the Voting Rights Act of 1965 since 1982, as demonstrated in the counties certified by the Attorney General for Federal examiner and observer coverage and the tens of thousands of Federal observers that have been dispatched to observe elections in covered jurisdictions.
(6) The effectiveness of the Voting Rights Act of 1965 has been significantly weakened by the United States Supreme Court decisions in Reno v. Bossier Parish II and Georgia v. Ashcroft, which have misconstrued Congress' original intent in enacting the Voting Rights Act of 1965 and narrowed the protections afforded by section 5 of such Act.
(7) Despite the progress made by minorities under the Voting Rights Act of 1965, the evidence before Congress reveals that 40 years has not been a sufficient amount of time to eliminate the vestiges of discrimination following nearly 100 years of disregard for the dictates of the 15th amendment and to ensure that the right of all citizens to vote is protected as guaranteed by the Constitution.
(8) Present day discrimination experienced by racial and language minority voters is contained in evidence, including the objections interposed by the Department of Justice in covered jurisdictions; the section 2 litigation filed to prevent dilutive techniques from adversely affecting minority voters; the enforcement actions filed to protect language minorities; and the tens of thousands of Federal observers dispatched to monitor polls in jurisdictions covered by the Voting Rights Act of 1965.
(9) The record compiled by Congress demonstrates that, without the continuation of the Voting Rights Act of 1965 protections, racial and language minority citizens will be deprived of the opportunity to exercise their right to vote, or will have their votes diluted, undermining the significant gains made by minorities in the last 40 years.

SEC. 3.
